Terms of Agreement

This Policy represents Inwave Internet's Acceptable Use Policy applicable to you and your subsidiaries and supersedes any other written or oral Policy. We reserve the right to revise this Policy at any time. By using any of the services offered by us, you are bound by and must comply with this Policy in its entirety. Violations of the guidelines, delineated below, will result in cancellation of your services or such other action as we, in our sole discretion, may deem appropriate.

System and Network Security
  • You may not tamper with other accounts, or commit unauthorized intrusion into any part of our system, or use any of our machines, files, accounts, and networks to intrude without authorization into any other system.

  • You may not use any of our services not included in your account, nor devise ways to circumvent security in order to access services you are not paying for. This clause includes, but is not limited to, the scanning of our network or other networks with intent to breach and/or evaluate security.

  • You may not use the system in a manner that encumbers disk space, processors or other system resources beyond those allowed by the specific type of account. You may not make deliberate attempts to interfere with a service, overload a service nor attempt to disable a host. If your account causes our servers to become overloaded due to high CPU or disk usage, we reserve the right to suspend or cancel your account without warning.

  • We will react strongly to the use or attempted use of Internet services or systems without the owner's authorization. This clause includes, but is not limited to, password cracking, defrauding others into releasing their passwords, denial-of-service attacks (sending packets with an illegal packet size, UDP flooding, ping-flooding, half-open TCP connection flooding, etc.). Additionally, you may not use programs, scripts, and commands nor send messages with the intent to interfere with a user's terminal session.

  • Email Abuse
  • Using mail services, mail-forwarding capabilities, POP accounts, or auto responders other than for a customer's own account is not allowed.

  • You may not send unsolicited email to any account that has not specifically requested information or that causes complaints from the recipients of such unsolicited email.

  • You may not continue to send commercial email to a recipient if that recipient has requested a discontinuation of such communication.

  • We prohibit the transmission of email that is harassing, libelous, defamatory, legally obscene or pornographic, threatening, abusive or hateful to non-consenting recipients.

  • The forwarding or propagation of chain letters of any type (including charity requests or petitions for signatures) is impermissible.

  • "Mail bombing" (i.e. flooding a user or site with large or numerous email messages) is strictly prohibited.

  • You may not forge header information.

  • We prohibit the use of your account, or network connection, to collect replies of messages sent from any another provider that violates the rules of this Policy or those of the originating provider.

  • The rules and regulations contained within this Policy apply to other means of Internet-based transmissions, including, but not limited to Internet fax or Internet phone.

  • Misuse of Domain Pointers
  • Domain pointers may not be used to reference a subdirectory of an existing web site. A pointer is appropriately used to have more than one way to reach a web site, not to create multiple sites under one domain. Each web site should have its own account with Inwave Internet

  • General
  • Internet connections and all other services provided to you by us may only be used for lawful purposes. Transmission or storage of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material. We reserve the right to remove any and all materials that infringe on copyright work. Such materials may be removed at any time upon receiving a complaint and/or notice of alleged copyright infringement.

  • Certain Internet services may contain language, pictures or other content which some individuals may find offensive, inflammatory, or of an adult nature. We do not endorse such materials and disclaim any and all liability for such content. Access to such materials is at your own risk.

  • Use of any information obtained via our service is at your own risk. We specifically deny any responsibility for the accuracy or quality of information obtained through our services.

  • Customer expressly agrees that use of the INWAVE service is at the customer's sole risk. Neither INWAVE, its employees, officers, directors, affiliates, agents, third party information providers, merchants, licensors or the like, warrant that the INWAVE service will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the INWAVE service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through the INWAVE service. The INWAVE service is provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied. INWAVE makes no warranty of any kind, either expressed or implied with respect to the software provided. In no event shall INWAVE be liable to you or any third party for consequential, special, indirect or incidental damages which might result from using the shareware software, including, but not limited to, loss of information or material of any kind.

  • The customer understands that enrollment and use of the INWAVE service constitutes an agreement to be legally bound and to abide by the terms of the INWAVE acceptable use policy.

  • Accounting and Billing
  • If at anytime your account goes beyond 30 days past due, your account will be placed On Hold and payment in full must be received before access can be restored. When you are reactivated, you will be given the choice of the current billing plans to pick from. Accounts that have been place On Hold greater than 2 times, will get a $20.00 reconnect fee.
  • A $3.00 late fee will be applied to all accounts per invoice after the 25th of the month.

  • All pre-paid accounts (ex. Quarterly, Semi-Annual, Annual), if canceled before the end of the term, will be charged at the highest rate applicable for such account. Refunds are not guaranteed.

  • It is the customers responsibility to write, email, or fax a confirmation of cancellation if you choose to cancel your account. Your account must be canceled before the end of the month for no new charges to be applied.

  • Any Monthly, Quarterly, Semi-Annual, or Annual account renews automatically when the term is up. If your account uses a Credit/Debit card the card will automatically be processed with the new charges. If your account is set up for invoicing you will be sent an invoice. Customers have the option to request their account be invoiced for the next term. You must notify us before your revolving account comes due again, to change payment types.

  • If you wish to report a violation of our Acceptable Use Policy, please email info@inwave.com. Please include all details of the violation in your email including all email header information. Each complaint will be investigated.
